Your Legacy to the World

Your work to tackle the climate crisis can continue for generations to come. For most of us, there comes a point when we start thinking about what we will leave behind. 

We want to be sure our loved ones are taken care of, but beyond that, we want to be sure that the world our children and grandchildren inherit will be a better place: a liveable biodiverse world, a more just and sustainable world. 

We invite you to join us as an Eco-Guardian by leaving a gift in your will to the West Coast Climate Action Network (WE-CAN), and become an enduring voice for the survival of younger generations and Earth’s ecosystems.  

Your legacy gift will be used:

  • to build stronger climate action groups and to form new ones; 
  • to train climate action group members; 
  • to support climate champions to advance stronger action in local government; 
  • to engage with Indigenous climate leaders;
  • to organize Climate Action Provincial Assemblies that bring people together to build a stronger movement.

General Advice

Our General Advice

Please be as clear as possible in describing your bequest.  Lack of clarity could result in litigation.

Always seek professional advice!  We can provide information and assistance; but we strongly encourage you to seek independent advice when making charitable gifts of annuities, securities, property, life insurance, wills, trusts, contracts and other legal documents.

Please do not place restrictions on a bequest. Priority projects we are working on today may not be priorities in the future. Give WE-CAN the discretion to use the funds in the manner that WE-CAN feels will achieve the greatest good.  A donor’s restrictions may be impractical for WE-CAN to comply with, or even be ultra vires (contrary to WE-CAN’s constitution and bylaws.) Instead, use the phase “to be used at the discretion of the organization”. 

 

Ensure your legacy lives on beyond WE-CAN.  Upon dissolution, Not-for-profits and registered charities must produce a statement listing gifts or other assets which they have legally acquired, what purposes these assets were to be used for, and how these assets would be redistributed.  If, in the future, WE-CAN can no longer continue as an organization, WE-CAN would specify that remaining assets be donated to another organization doing similar work. If the bequest states that the funds be used at the “discretion of the organization” then the transfer of funds to another organization working on similar issues as WE-CAN can be easily done.

WE-CAN will not be able to issue tax receipts nor will your donation to WE-CAN help reduce probate fees. Solving the climate crisis requires political engagement, and WE-CAN must be able to retain its ability to advocate with municipal, provincial and federal governments for necessary changes.  Thus, we have decided not to take out registered Canadian charitable status.  Because of this, WE-CAN will not be able to issue tax receipts for legacy gifts.  We hope you will agree with our need to stay independent of government, and will continue to support us.

Wills and Codicils

Wills and Codicils

Whether you are drafting your first Will or are revising your current Will, including a bequest to WE-CAN is quite simple.  You can bequest all (or a percentage) of the residue of your estate after your loved ones have been taken care of.  You can also choose to give a specific dollar amount.

Please Note:  West Coast Climate Action Network Society is a registered non-profit society (Business Number 75986 5348 BC0001). We do NOT have charitable status.  To ensure clarity, please use the term “not-for-profit organization” (do not use the term “charitable organization”) when referring to WE-CAN in your will.

Wording for Cash Gifts:
Sample wording for a residual gift in your will:
“I give to West Coast Climate Action Network Society,  currently of 13561 Barney Road, Ladysmith, British Columbia, V9G 1E9 all (or ______%) of the residue of my estate, to be used at the discretion of the organization.”

Sample wording for a specific gift in your will:
“I give to West Coast Climate Action Network Society, currently of 13561 Barney Road, Ladysmith, British Columbia, V9G 1E9, the sum of $______ to be used at the discretion of the organization.”

Wording for Gifts Other than Cash (eg Real Estate, Personal Property, Private Company Shares)

Policies for Accepting Gifts Other than Cash:

Please discuss the proposed gift with WE-CAN ahead of time to ensure that WE-CAN will be able to properly accept such property and either sell it or put it to good use.  Please be aware that unless the non-cash gift is considered useful to WE-CAN’s work, it will be sold, and the proceeds will be used by WE-CAN in accordance with our organizational objectives.

Gifting Real Estate:  Before accepting such a bequest, WE-CAN will need to know if there are any liens or attendant liability that come with the property.  One thing to check out is whether the property has been environmentally assessed— what if the property has contamination issues?  Has the property been properly assessed for its market value?  Would the property be difficult to sell?

Gifting Shares: If the bequest is in the form of shares from a private corporation or company, we would need to check out the company before accepting. Some shares can be difficult to value and even more difficult to sell.

Sample Wording: Bequests of property including real estate or valuable items such as stocks, bonds, jewellery, or works of art: “ I give to West Coast Climate Action Network Society, currently of 13561 Barney Road, Ladysmith, BC V9G 1E9,  the sum of (description of property) to used at the discretion of the organization.”

Bequests of the rest or residue of your estate: “ I give to West Coast Climate Action Network Society, currently of 13561 Barney Road, Ladysmith, BC V9G 1E9,  the sum of all (or a stated percentage) of the rest or residue and remainder of my estate to used at the discretion of the organization.”

Sample wording for Contingent bequests.  On Contingent Bequests, WE-CAN would only receive the gift should the heirs specifically named in the will die before the individual does.

“ If (name(s) of primary beneficiaries) do(es) not survive me, or die(s) within (90) days of my death, or as a result of common disaster, then I give to West Coast Climate Action Network Society, currently of 13561 Barney Road, Ladysmith, BC V9G 1E9,  (describe specific amount of money or percentage of residual estate) to be used at the discretion of the organization.”

Making changes to a will by means of a codicil

To avoid the expense of having a new Will drawn up, minor alterations can be made to an existing will by means of a codicil.  A codicil is an amending document that changes or deletes an existing provision, or adds an entirely new one. Codicils are signed and witnessed in the same way wills are, and are kept with the will.  If your changes are major, then you should seek professional advice to determine whether you should have a new will drawn up.

Other Ways to Leave a Lasting Gift

Gifts of Life Insurance:  There are 3 options:

  • An existing permanent policy with a cash value can be signed to WE-CAN
  • A new policy can be taken out by individuals or couples on their lives, or the life of a loved one, and gifted to WE-CAN.
  • You can make WE-CAN the beneficiary of a life policy.

Please consult with your insurance agent on rules, regulations, and the documentation that needs to be done. 

Gifts of RRSPs and RRIFs

You can make WE-CAN the beneficiary of your RRSPs or RRIFs.  Ask the institution holding these instruments to send you a change of beneficiary form 

Two ways to make a gift of an RRSP or RRIF

  1. Name WE-CAN as the designated primary beneficiary, or as a secondary beneficiary in the event your spouse or other primary recipient should pass on before you.  It is not necessary to amend your will in order to take advantage of this option.  Designating a not-for-profit or charitable beneficiary does not affect your own use of the retirement funds in any way.  The after-tax amount of funds remaining the account upon your demise will go to WE-CAN.
  1. Leave the proceeds of your RRSP or RRIF to WE-CAN in your will. 

Word of Caution:  If you choose to withdraw money from your retirement fund during your lifetime to make a donation to WE-CAN, we recommend that you carefully review the tax implications with your financial advisor.
